Meeting called to order at 6:07 p.m.

Agenda Item #1 – Minutes

Rodney Pingree made a motion to accept the minutes of August 7, 2002.  Jim Bralich seconded the motion.  All were in favor.


Agenda Item #2 – Other communications/mail

Linda Baker noted multiple fall workshops available from VLCT, the American Planning Association, and at VLCT’s Town Fair 2002 on October 26th in Killington.


The Commission reviewed the 2002 request for grant proposals from Lake Champlain Basin Program.


The Commission reviewed the hearing date scheduled for proposed updates of the Stowe Town Plan, and filed Stowe’s Town Plan information.


Linda Baker telephoned Select Board member Pete Siegel during the meeting regarding the municipal planning grant and the hiring of a professional planner.  Mr. Siegel stated that the Select Board did want the Planning Commission to move forward with applying for the grant, and that a professional planner had not yet been hired.


Agenda Item #3 – Review of the final draft of the Zoning Regulations

Revisions to the Zoning Regulations:

1.      Add “ACT” to definitions, Article VI, General Regulations, Section 17.

“1.  Act: The Vermont Municipal and Regional Development Act, 24 VSA, Chapter 117, Section 4401.”


2.      Page 12.  Article V Permits and Approvals.  Section 1. E.  Issuance of permit.

  1. “The Administrative Officer shall not issue a zoning permit until the applicant has (delete substantially) complied with the requirements of these zoning bylaws.”
  2. “Each zoning permit issued under this section shall contain a statement of the period of time within which an appeal by an interested person (as defined by the Act) may be taken.”


3.      Page 13.  Article V Permits and Approvals. Section 1. H. Revocation of Permits and Approvals.

“In addition to any other remedies provided by the law, any permits or approvals obtained under these regulations may be canceled or revoked by the Administrative Officer or Development Review Board, whichever entity granted the permit or approval…”


4.      Page 15.  Article V Permits and Approvals.  Section 4. Site Plan Review.

B.    Site Plan Review Submittal Data

a.      “1.  The name and address of the applicant, the owners of record of adjoining lands, and the person or firm responsible for preparing the map.”

b.     Move “landscaping plans, including site grading, screening, planting and erosion control” to the end of the sentence in #4.

c.      Page 16. D. Site Plan Review Standards

“3.  Adequacy of landscaping, screening…to achieving maximum compatibility with and protection of adjacent properties.”


The Commission tabled the review of the Zoning Regulations on page 18 to move onto Agenda Item #4.


Agenda Item #4 – Joss Besse/Municipal Planning Grant Review

Joss Besse reviewed some of the requirements of the municipal planning grant with the Commission noting that;

a.      CCRPC will be conducting a meeting at the Bolton Town Office on Tuesday 9/17/02 at 8:30 a.m. to take comments on the Town Plan, and will be voting whether to approve the Town Plan at their 9/24/02 meeting..

b.      grant notification will occur 11/4/02, and if the Town does receive the grant funding, the grant project will need to be put out to bid.

c.      the grant project may not be started before funding and bids are secured.

d.      there is no matching fund requirement for the Town.

e.      the Town would have 18 months to complete the grant project activities, with a close out date of spring 2004.


The Commission and Joss discussed the grant objectives, acknowledging the principal need for a special study of Village II density, and for the results of that study to be fed into both the Zoning Regulations and Town Plan.


The Commission and Joss drafted two brief narratives needed for completing the grant application, and Linda Baker signed off on the grant application form.


Joss suggested that the Commission check on the validity of the current interim zoning if new zoning regulations are adopted.


Agenda Item #5 – Draft schedule for future items to be addressed.

Tabled until the next meeting.


Agenda Item #6 – Any other business

The next scheduled meeting of the Planning Commission will be on Wednesday, October 16, 2002, 6 p.m. at the Town Office.


Agenda Item #7 – Adjournment

The meeting adjourned at 8:15 p.m.
